GEN 4.2.1.   Approach control

GEN 4.2.1.1   Definition of a flight which is liable to pay the charge

Terminal charges shall be levied for each flight made in accordance with Standards and Recommended Practices of the ICAO (General Aviation Traffic - GAT) which depart from any aerodrome or defined aerodrome within Zagreb FIR.

GEN 4.2.1.2   Calculation formula
The terminal charge R shall be calculated in accordance with the following formula:
R = t x N

where t is the unit rate of charge and N the number of service units corresponding to provided terminal services.

For a given departing flight, the number of service units in respect of terminal charges, designated N, shall be the quotient, obtained by dividing by fifty the Maximum Take-off Weight (MTOW), to the power 0.70. The Maximum Take-off Weight shall be expressed in metric tons and shall be the one used for calculating the EUROCONTROL route charge for the flight concerned.

For the purpose of calculating the charge, N shall be expressed as figure taken to two decimal places.

GEN 4.2.1.4   Exemptions

The following categories of flights shall be exempted from the payment of terminal charges:

  • Flights performed by aircraft of which the maximum take-off weight authorised is less than two (2) metric tons;
  • Mixed VFR/IFR flights in the charging zones where they are performed exclusively under VFR and where a charge is not levied for VFR flights;
  • Flights performed exclusively for the transport, on official mission, of the reigning Monarch and his/her immediate family, Heads of State, Heads of Government, and Government Ministers, provided that in all cases this must be substantiated by appropriate status indicator in the flight plan;
  • Search and rescue flights authorised by the appropriate competent body;
  • Military flights of any country;
  • Training flights performed exclusively for the purpose of obtaining a licence, or a rating in the case of cockpit flight crew, where this is substantiated by an appropriate remark on the flight plan; flights must be performed solely within the airspace of the Republic of Croatia and must not serve for the transport of passengers and/or cargo, nor for positioning or ferrying of the aircraft;
  • Flights performed exclusively under Visual Flights Rules (VFR);
  • Humanitarian flights;
  • Flights performed exclusively for the purposes of checking or testing equipment used or intended to be used as ground aids to air navigations;
  • Flights terminating at the aerodrome from which the aircraft has taken-off and during which no intermediate landing has been made (circular flights);
  • Police and Customs flights.
GEN 4.2.1.5   Methods of payment

Terminal charges shall be collected in accordance with the following condition of payment:

The amounts billed are payable in Euro into the EUROCONTROL, Central Route Charges Office's bank account shown on the bill.

The amount of the charge is due on the date of performance of the flight. The latest value date by which payment must be received by EUROCONTROL shall be shown on the bill and is 30 days from the date of the bill.

Payment shall be deemed to have been received by EUROCONTROL on the value date on which the amount due was credited by the bank of EUROCONTROL referred to in Article 1, paragraph 1 above. The value date shall be the date on which EUROCONTROL can use the funds.
Payments made shall be accompanied by a statement giving the references, dates and Euro amounts in respect of bills paid and of possible credit notes deducted.

Where a payment made is not accompanied by the details specified in paragraph 1 above to allow its application to a specific bill or bills, EUROCONTROL will apply the payment:

  • first to interest, and then
  • to the oldest bills unpaid

Claims against bills must be submitted to EUROCONTROL in writing or by an electronic medium previously approved by EUROCONTROL.The latest date by which claims must be received by EUROCONTROL shall be shown on the bill and is 60 days from the date of the bill.

The date of submission of claims shall be the date on which the claims were received by EUROCONTROL.

Claims must be detailed and should be accompanied by any relevant supporting evidence.

Submission of a claim by a user does not entitle him to make any deduction from the relevant bill unless so authorised by EUROCONTROL.

Where EUROCONTROL and a user are mutually debtor and creditor no compensation payments shall be effected without EUROCONTROL´s prior agreement.

Any charge the amount of which has not been paid by the due date of the bill shall be increased by the addition thereto of Interest on Late Payment, which shall be simple interest calculated from day to day on the unpaid overdue amount.

The interest will be calculated and billed in Euros (EUR).

Where a debtor has not paid the amount due, measures may be taken by EUROCONTROL to enforce recovery.

GEN 4.2.2.   ANS Route

GEN 4.2.2.1.1   Introduction

The Republic of Croatia applies EUROCONTROL system to en-route charges and conditions of payment.

GEN 4.2.2.2   Calculation formula

En-route charges are calculated in accordance with the formula from the EUROCONTROL Conditions of Application of the Route Charges System and Conditions of Payment.

GEN 4.2.3.   Cost basis for ANS and exemptions/reductions

GEN 4.2.3.1   Legal basis for Air Navigation Services

Legal basis for Air Navigation Services are: Air traffic law (“Official Gazette” No. 69/09, 84/11, 54/13, 127/13 and 92/14), the Act on Establishing the Croatian Air Navigation Services (“Official Gazette” No. 19/98, 20/00 and 51/13) and the Ordinance laying down en route and terminal charges (“Official Gazette” No. 91/13).

GEN 4.2.3.2   Exemptions/reductions

In addition to the flights specified by the EUROCONTROL Conditions of Application, the following flights shall be exempt from the payment of charges:
